HairFix - Terms of Use

Welcome to HairFix!

These Terms of Use ("Terms") govern your access to and use of the HairFix mobile application (the "App") and its services. Please read these Terms carefully before using our App.

By downloading, accessing, or using the HairFix App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. Description of Service

HairFix is a mobile application that uses artificial intelligence (AI) to generate new hairstyles and hair colors on a selfie photograph provided by the user ("Service"). The service is intended for entertainment and visualization purposes only.

2. Acceptance of Terms

By using our Service, you confirm that you are at least 13 years of age and that you accept these Terms. You are responsible for ensuring that your use of the App complies with all laws, rules, and regulations applicable to you.

3. User Conduct and Responsibilities

You agree to use the HairFix App only for its intended purpose and in a lawful manner. You are solely responsible for the content you provide. You agree not to:

• Upload any photograph that you do not have the legal right to use.
• Upload any photograph that contains nudity, violence, hate speech, or is otherwise offensive, illegal, or obscene.
• Use the App to harass, bully, or intimidate others.
• Attempt to decompile, reverse engineer, or otherwise attempt to obtain the source code of the App.
• Use the generated images for any commercial purpose without our express written consent.
• Violate any applicable local, state, national, or international law.

We reserve the right to terminate your access to the App for violating these rules.

4. Intellectual Property Rights

• Your Content: You retain full ownership and all rights to the original selfie photograph you upload to the App. We claim no ownership over your original content.
• Our Service and AI-Generated Content: All rights, title, and interest in and to the App, its "look and feel," the underlying AI models, algorithms, and the software are and will remain the exclusive property of HairFix and its licensors. The hairstyles and visual elements generated by our AI ("Generated Content") are owned by HairFix. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Generated Content for personal, non-commercial purposes. You may save these images to your device and share them on social media for personal use.

5. Disclaimers

The HairFix App is provided on an "AS IS" and "AS AVAILABLE" basis.

• No Guarantee of Accuracy: The hairstyles and colors generated by our AI are for simulation and entertainment purposes only. They are not a guarantee of what a real-world hairstyle or color will look like on you. Results may vary, and we do not guarantee the realism or accuracy of the Generated Content.
• No Professional Advice: The Service does not provide professional hairdressing, medical, or cosmetic advice. Always consult with a qualified professional before making any decisions about your hair.

6. Limitation of Liability

To the fullest extent permitted by applicable law, HairFix, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• (a) your access to or use of or inability to access or use the Service;
• (b) any content obtained from the Service; or
• (c) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless HairFix and its employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.
